GENERAL<\/strong><\/p>\n<p>1. Scope: The following General Terms and Conditions (GTC), in the version valid at the time of engagement, shall exclusively apply to the commissioning, creation, and execution of the tattoo\/permanent makeup (PMU) as well as any other services provided to customers. Other GTCs are not recognized and therefore do not form part of this contract. This specifically applies to any GTCs whose content goes beyond the provisions of these GTCs.<br \/>2. Contracting Party: The contracting party for the commissioning, creation, and execution of the tattoo, as well as any other services, is the respective tattoo artist who performs and carries out the work. These GTCs apply to the tattoo artist.<\/p>\n<p><strong>II. CONCLUSION OF CONTRACT<\/strong><\/p>\n<p>1. The contract is concluded between the tattoo artist and the client.<br \/>2. The contract between the tattoo artist and the client is concluded when a written or oral order from the client is accepted by the tattoo artist. The order can be accepted within two weeks of receipt, either in writing, electronically (by email or messenger), or verbally. A copy of the written order does not constitute acceptance unless expressly confirmed in writing or electronically.<br \/>3. Orders are always accepted only based on the terms agreed upon at the time of the appointment.<br \/>4. Any changes requested by the client constitute a modification of the contract and may justify the rejection of the order.<br \/>5. The tattoo artists reserve the right to reject orders and clients without providing a reason. Possible reasons may include, for example, motif requests with religious or political content, motifs that are offensive to humans or animals, motifs that the tattoo artist cannot morally or ethically support, insistence on tattooing particularly exposed body areas or intimate regions, motifs containing recognizable names, among others.<\/p>\n<p><strong>III. TATTOING CONDITIONS<\/strong><\/p>\n<p>1. Only adults are tattooed. Minors may be tattooed only if accompanied by a legal guardian who provides written consent. This person must sign the consent form on-site at the studio.<br \/>2. Only legally competent individuals are tattooed\u2014those who demonstrate a mental and maturity state that does not prevent them from giving valid consent to a bodily injury.<br \/>3. The tattoo is subject to the condition that there are no exclusion criteria on the part of the client that would prevent the professional execution of the tattoo. Exclusion criteria include, but are not limited to:\n\na. Alcohol intoxication within 48 hours prior to the appointment,\nb. Drug intoxication within 48 hours prior to the appointment,\nc. Intake, influence, or administration of anticoagulant, wound-healing-impairing, or other medications that would prevent or complicate tattooing at the appointment,\nd. Use of topical anesthetics (e.g., Emla),\ne. Use of depilatory creams or similar products,\nf. Unapproved use of products to prepare the area to be tattooed,\ng. Medical conditions that prevent or complicate tattooing, particularly infectious or viral diseases, wound healing disorders, blood clotting disorders, asthma, diabetes, hepatitis, HIV, or epilepsy\u2014these must be cleared with a doctor in advance,\nh. Presence of known allergies to ingredients in tattoo inks or other tattoo and hygiene products,\ni. Pregnancy or breastfeeding of the client,\nj. An unreasonable state of hygiene of the client,\nk. Indications or appearance of behavior or attitudes that question or render the professional execution of the tattoo unsafe,\nl. Refusal to provide written consent to bodily injury.<br \/>4. The client is obliged to inform the tattoo artist in advance about any known allergies, medications, illnesses, and any other exclusion criteria.<br \/>5. The client is obliged to provide a written and signed consent form prior to the tattoo procedure. Furthermore, the client agrees to provide all information truthfully and to present a valid identity card, passport, or driver\u2019s license to verify their age.<br \/>6. The tattoo will be carried out in strict compliance with all hygiene regulations. Only professional instruments, aids, and techniques will be used.<br \/>7. Prior to performing the tattoo, the tattoo artist informs the client about risks, side effects, care, and aftercare. Upon request, written brochures and information sheets are also provided. Furthermore, all information is available on the website under the \u201cCare Instructions\u201d section. In addition, the client confirms that they have already familiarized themselves in advance with the procedure and risks of a tattoo.<\/p>\n<p><strong>IV. APPOINTMENTS<\/strong><\/p>\n<p>1. Tattoos are performed by appointment only.<br \/>2. Upon acceptance of the order, a binding appointment is scheduled for one or more sessions.<br \/>3. Upon conclusion of the contract, the client pays a deposit\/advance payment of 30%.<br \/>4. The appointment deposit must be refunded to the client as a voucher if:\n   a. the client cancels the order within the first 14 days by phone, in writing, or in person, and the tattoo artist has not yet performed any work;\n   b. the client cancels at least 48 hours before the first appointment by phone or in person, no replacement appointment is scheduled, and the tattoo artist has not yet performed any work;\n   c. the client cancels the first appointment for reasons or circumstances that are demonstrably not their fault;\n   d. the tattoo artist cancels the first appointment for reasons or circumstances that are not the client\u2019s fault.<br \/>5. A refund or transfer of the appointment deposit to another person is excluded once:\n   a. the commissioned tattoo artist has begun creating an individual design, preliminary sketch, or other preparatory work as agreed in the contract;\n   b. the first of one or more scheduled sessions has begun with tattooing.<br \/>6. Any refund of the appointment deposit under section IV.4 will be issued in the form of a tattoo voucher equal to the amount of the deposit paid. A cash refund of the appointment deposit is excluded.<br \/>7. Appointment rescheduling is possible by phone, in person, or in writing. The client is explicitly informed of this.<br \/>8. If the client requests a rescheduling at least 7 business days before the agreed appointment and a replacement appointment is scheduled within the next 3 months, the deposit paid for the original appointment will still be credited toward the total price after the tattoo is performed. If the replacement appointment takes place 3 months or later, the deposit for the original appointment will not be credited toward the total price.<br \/>9. In cases of illness, accident, or other extraordinary circumstances involving a prolonged period of incapacity, the deposit paid may remain valid for an extended period upon agreement with the tattoo artist.<br \/>10. If an appointment cannot take place for reasons not attributable to the client (section IV.4.c), the client is entitled to arrange a replacement appointment.<br \/>11. In all other cases of appointment cancellation or no-shows, there is no entitlement to a replacement appointment, and the deposit is forfeited.<br \/>12. If an appointment cannot take place for reasons attributable to the client, the scheduling of a replacement appointment is at the sole discretion of the tattoo artist.<br \/>13. If an appointment cannot take place due to the tattoo artist\u2019s cancellation for reasons not attributable to the client (section IV.4.d), a replacement appointment will be scheduled at the earliest possible date.<br \/>14. There is no entitlement to preferential scheduling of a replacement appointment.<br \/>15. If no deposit has been paid for a follow-up tattoo appointment and the client cancels or does not attend, the right to another free follow-up appointment within the service period is forfeited.<br \/>16. If an exclusion criterion under section III.3 exists or becomes known, this is considered a cancellation by the client for which the client is responsible.<br \/>17. There is no entitlement to a preferred appointment date.<br \/>18. The deposits paid will be credited against the total price after the tattoo has been performed. If installment or full payment after the last appointment has been agreed, the deposit will be applied to the fee due for the final appointment.<br \/>19. At the appointment, the client has checked the stencil imprint for accuracy and placement and agrees to the start of the tattoo.<br \/>20. In case of withdrawal after the start of preparations (e.g., sketch creation), there is no entitlement to a refund of the deposit.<br \/>21. If the client agrees to have a photo taken of the final result, the client also consents to its use for advertising purposes and publication on the Internet.<\/p>\n<p><strong>V. PAYMENT AND PRICES<\/strong><\/p>\n<p>1. Tattoos are individually designed motifs, tailored specifically to the client and their wishes. Both during the design phase and the execution of the tattoo, unexpected difficulties or other factors may arise or become known (such as skin condition, client\u2019s pain tolerance, and more), which can increase the complexity of the work and affect the price. Therefore, a fixed statement regarding the final tattoo price is not possible.<br \/>2. Prices are always determined individually and on a project basis. Two identical motifs performed by the same tattoo artist may differ in price for different clients.<br \/>3. At the conclusion of the contract, the tattoo artist provides an estimate of the individual price per session (session price), which depends on the size and complexity of the tattoo, body location, skin condition, choice of motif, style, and color, artistic and technical effort, last-minute changes to the design, and the required instruments. Additionally, the tattoo artist provides a range within which the session price is expected to fall, assuming no factors arise that affect the effort, duration, complexity, feasibility, or similar aspects of the procedure. Estimates are provided only for the session price, not for the final total price.<br \/>4. The session price also includes the tattoo artist\u2019s individual preparatory work. This particularly, but not exclusively, includes:\n   a. personal, telephone, and written consultation with the client,\n   b. development of the motif, its style, and determining the correct body placement,\n   c. creation of sketches, preliminary drawings, and the tattoo design template, including, if necessary, freehand application of the design,\n   d. preparation of the body area.<br \/>5. Cost estimates provided by the tattoo artist to the client are valid only if given in person.<br \/>6. Prices and fees paid by the client include the statutory value-added tax (VAT). If the statutory VAT changes after the conclusion of the contract, the new applicable VAT rate shall be considered agreed.<br \/>7. A free touch-up within 6 months after the tattoo (post-service period) is included if deemed necessary. The necessity is determined by the tattoo artist. The touch-up is limited to achieving the stitch result agreed upon at the conclusion of the contract. Motif changes, extensions, redesigns, or additions are not included and must be agreed upon separately. After the post-service period, touch-up appointments must be paid for and secured with a deposit. Pricing is based on the original session price. A free touch-up is excluded if the need arises from the client\u2019s incorrect aftercare.<br \/>8. If a client repeatedly requests the creation of a new design, even though the submitted designs from the tattoo artist already meet the client\u2019s wishes and specifications as agreed at the conclusion of the contract, the tattoo artist reserves the right to charge separately for any additional designs.<br \/>9. If a client interrupts the tattoo procedure for reasons attributable to them before half of the session duration has passed, the tattoo artist reserves the right to charge a cancellation fee of 100.-.<br \/>10. Vouchers are valid for all services. Vouchers are not redeemable for cash, not even in part. Vouchers are transferable and valid for 1 year from the date of issue. For a single session, the voucher is applied to that session; for multiple sessions, it is applied to the last session. If the voucher value exceeds the final price after the tattoo has been performed, the date of the tattoo will be noted on the voucher, and the voucher retains its validity for the remaining value for the rest of the one-year period from the date of issue. A voucher does not entitle the holder to a tattoo, particularly not to a specific motif. If exclusion criteria under section III exist, the tattoo artist expressly reserves the right to refuse the voucher holder. A voucher does not entitle the holder to a tattoo on a specific date, nor does it entitle them to a tattoo without an appointment or order acceptance. In all cases of impediment, the tattoo artist and client will strive to find a solution that is fair and reasonable for both parties.<br \/>11. Payment is made in full either in cash or via TWINT after the service has been completed.<\/p>\n<p><strong>VI. TATTOO AFTERCARE<\/strong><\/p>\n<p>1. The client will be thoroughly informed about the care and aftercare of their tattoo at each session. They will be advised about the risks and potential consequences associated with tattoo care and aftercare.<br \/>2. Written aftercare instructions will be provided to the client at each session, and any questions regarding them will be discussed.<br \/>3. The client is required to follow the written aftercare instructions and to contact the tattoo artist immediately or consult a specialist doctor in case of unexpected healing complications. Any costs incurred will not be covered by Pharma Ink Tattoo &amp; PMU Studio.<br \/>4. The care and aftercare of the tattoo are the responsibility of the client.<br \/>5. The information provided in these GTCs does not constitute a complete representation of the aftercare instructions.<br \/>6. The client is advised that adherence to the aftercare instructions is crucial for the final result.<br \/>7. Color variations, darkening, or lightening may occur due to individual metabolism, skin type, or the healing process and do not constitute grounds for a complaint.<br \/>8. The aftercare instructions are uploaded on the www.pharmaink.ch website.<\/p>\n<p><strong>VII. DATA PROTECTION AND USAGE RIGHTS<\/strong><\/p>\n<p>1. Pharma Ink Tattoo &amp; PMU Studio and the tattoo artist collect data necessary for the execution of the tattoo, which must be processed and stored. This includes personal, contact, and health data. All data is treated confidentially, not shared with third parties, and used solely for the purpose of performing the tattoo and for promotional purposes.<br \/>2. The client is informed separately about this and provides explicit consent for the processing of their data upon conclusion of the contract. The information provided in these GTCs does not constitute a comprehensive privacy policy.<br \/>3. The client grants the tattoo artist an unlimited, unrestricted, and free right to use, reproduce, and publish all photographs and videos taken before, during, and after the tattooing of the tattoo and the tattooing process.<br \/>4. Photos or videos will be used exclusively for documentation and promotional purposes. Upon request, the client can object to a publication in writing.<br \/>5. Publication will never occur without protecting privacy (e.g., without a recognizable face, if the client so desires).<br \/>6. The tattoo artist grants the client an unrestricted, indefinite, and irrevocable right of use to the completed tattoo. This right of use only includes provided, photographed, or filmed sketches, drafts, and templates if the tattoo artist has expressly consented to this in writing.<br \/>7. If a tattoo is not performed or completed, for any reason and regardless of who is responsible, the transfer of the rights of use for the underlying sketches and templates is excluded.<br \/>8. The stored data is available for the client to inspect upon request.<\/p>\n<p><strong>VIII. DISCLAIMER OF LIABILITY<\/strong><\/p>\n<p>1. If any liability may arise from the execution of the tattooing, this liability is limited to the contractual relationship between the respective tattoo artist and the customer.<br \/>2. A tattoo constitutes bodily harm and an infringement of physical integrity, which is associated with pain. The customer is informed of this before the tattooing and confirms their free and unrestricted will to do so in writing.<br \/>3. The tattoo artist works according to the highest hygiene standards and in compliance with all legal, official, and technical requirements. They only use professional, sterilised tattooing instruments, sterilised tattooing accessories, or sterile disposable and hygiene articles. They only use tattoo inks and tattooing agents in accordance with the guidelines of the Federal Office of Public Health (FOPH). They exercise the greatest possible care to best meet the customer's wishes. Nevertheless, the result may deviate from the design. The nature of the skin, the customer's condition on the day, the ability of the skin to absorb tattoo ink, the specific structure of the body part to be tattooed, the customer's natural skin colour profile, and other factors are subject to unpredictable influences that can affect the final result and lead to deviations.<br \/>4. Any liability of the tattoo artist for damages, regardless of the legal basis, is rejected.<br \/>5. The liability of the tattoo artist for performed tattoos is limited to gross negligence and intent (willful misconduct). Liability arising from gross negligence is excluded beyond the final price of the tattoo. Liability arising from intent is excluded beyond the actual damage.<br \/>6. The tattoo artist, their representative, or assistant is not liable in the case of simple (ordinary) negligence, unless it concerns a breach of essential contractual obligations.<br \/>7. Insofar as the tattoo artist, their representative, or assistant is liable for damages according to the basis in section VIII. 5., this liability is limited to damages that were foreseen as a possible consequence of a breach of contract at the time the contract was concluded, or that should have been foreseen with the application of customary commercial diligence.<br \/>8. There shall be no liability for complications and possibly resulting consequences that arise from the existence of grounds for exclusion according to section III., about which the tattoo artist was not informed.<br \/>9. The data protection declaration (privacy policy) can be viewed as a notice posted in the studio and will be handed out upon request.<br \/>10. There shall be no liability for complications and possibly resulting consequences that arise from the customer having neglected, not followed, or acted contrary to the aftercare instructions provided. This includes, but is not limited to, wound infections, inflammation, scarring, and damage to the tattoo.<br \/>11. If the tattooing to be performed is the covering of an existing tattoo or scars (Cover-Up Tattoo\/PMU), complications may arise, for which no liability shall be assumed, unless they were caused by gross negligence or intent. It is expressly pointed out that already tattooed skin is pre-stressed and may show tissue or structural changes that influence the result of the covering tattoo. Interactions may occur between the already introduced tattoo ink and the new tattoo ink, which can cause unforeseeable skin reactions and lead to aesthetically unwanted results, unless otherwise specified in writing.<br \/>12. The tattoo artist is not liable for indirect damages, consequential damages, or loss of profit.<br \/>13. Rework (a touch-up\/correction) can only be requested within 6 months after the treatment and following a personal assessment in the studio.<br \/>14. The customer can only assign claims against the tattoo artist to third parties with the written consent of the tattoo artist.<br \/>15. Should a provision from these General Terms and Conditions (GTC) or from the contractual relationship between the tattoo artist and the customer be or become ineffective, these GTC and the remainder of the contract shall remain unaffected. The ineffective provision is to be replaced by an effective provision that comes as close as possible in meaning to the ineffective one. The natural healing process of the skin can lead to changes in the tattoo and affect the appearance of the design. This includes, but is not limited to: spider veins, blow-outs, fade-outs, scarring, raised skin, colour fading, colour bleeding\/undermining, colour gradients, and loss of intensity. No liability is assumed for these normal skin reactions during the healing process or for skin reactions that have arisen due to faulty aftercare.<br \/>16. No liability is assumed for clothing, shoes, backpacks, bags, and similar items that are soiled or damaged by tattoo ink, disinfectant, or similar materials, unless the soiling or damage was caused by the tattoo artist through gross negligence or intent.<br \/>17. The foregoing exclusions of liability do not apply to liability for willful misconduct (intentional behaviour), for injury to life, body, or health, for liability under the Product Liability Act, or for guaranteed quality characteristics.<br \/>18. The hygiene plan can be viewed as a notice posted in the studio and will be handed out upon request.<\/p>\n<p><strong>IX. FINAL PROVISIONS<\/strong><\/p>\n<p>1. All contractual relationships between the tattoo artist and the customer, as well as all disputes that may arise from these relationships, are exclusively subject to the laws of Switzerland.<br \/>2.
